Welcome to Grant Ready Kentucky! We are excited to assist qualifying communities and nonprofit entities in Kentucky (“Qualifying Nonprofit Organizations”) by helping to facilitate access to grant-related information, resources and services, including access to free consulting services (“Consulting Services”) provided by independent, third-party consultants who offer grant-related advice and grant-writing services to Qualifying Nonprofit Organizations (collectively, the “Services”).
Acceptance of the Terms
These terms and conditions, together with any other documents incorporated by reference (collectively, “Terms”), govern your access to and use of all websites operated by Grant Ready Kentucky, Inc. or one of its affiliates (“Grant Ready Kentucky”, “we”, “us” or “our”), and your access to and use of the Services and any services made available to you on or through any of our websites (collectively, the “Site”), unless a third party terms and conditions and/or policy applies in accordance with these Terms. If you are agreeing to these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on that organization or entity’s behalf and bind it to these Terms.
Please read these Terms carefully before you stare to use the Site. The Site is offered and available to U.S. entities and to U.S. residents who are at least 18 years of age. By using this Site, you represent and warrant that you are of legal age to form a binding contract with us and meet all eligibility requirements. BY USING THE SITE OR BY CLICKING TO ACCEPT OR AGREE TO THE TERMS WHEN THE OPTION IS MADE AVAILABLE TO YOU, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS (WHETHER ON BEHALF OF YOURSELF OR A LEGAL ENTITY YOU REPRESENT). IF YOU DO NOT WANT TO AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SITE.
Tax-Exempt Status
Grant Ready Kentucky is fiscally sponsored by Blue Grass Community Foundation, a tax-exempt charitable organization (the “Sponsor”). Nothing in these Terms is intended to jeopardize Sponsor’s status as a 501(c)(3) organization, as defined in the Internal Revenue Code of 1986, as amended (the “Code”). This Agreement shall be interpreted in a manner consistent with the foregoing intention and so as to conform to the provisions of any and all applicable law or government regulation.
Eligibility for Consulting Services
To be eligible for Consulting Services, Qualifying Nonprofit Organizations must be either:
You agree to provide us with any information that we may reasonably request related to your status as a Qualifying Nonprofit Organization. We reserve the right to deny or revoke your ability to receive Consulting Services for any reason, and you acknowledge and consent to our use of third party service providers to review and verify your status as a Qualifying Nonprofit Organization.
Your Responsibilities, Representations and Warranties
You represent and warrant that all information you submit to us must be, and is, accurate, truthful and current. If we believe that your information is not truthful, accurate, legal, or current, we have the right to terminate, suspend, or refuse you access to and use of the Site.
You represent and warrant that you are, at all times applicable to these Terms, a Qualifying Nonprofit Organization, and that you will promptly notify us if you no longer qualify as a Qualifying Nonprofit Organization. You bear sole responsibility for complying with all laws, rules and regulations applicable to your activities under these Terms and to your status as a Qualifying Nonprofit Organization.
You acknowledge and agree that you are solely responsible for verifying the accuracy of all information you receive in connection with the Site or Services, whether from us or any third party provider, including any information relating to grant applications or eligibility. For example, you should always verify grant deadlines and eligibility directly with the entity issuing the notice of the funding opportunity.
No Legal or Tax Advice
You acknowledge and agree that Grant Ready Kentucky does not provide legal, accounting or tax advice, and that the Services, including Consulting Services and any and all other information or services provided on or made available through the Site, are for general information and charitable purposes only, should never be construed as legal, accounting or tax advice, and are not a substitute for obtaining actual legal, accounting or tax advice from a qualified professional. Furthermore, you acknowledge and agree that certain Services, including Consulting Services, may be provided by independent, third party providers not under the control of Grant Ready Kentucky, and that Grant Ready Kentucky is not responsible for the accuracy, quality, or content of any information or services provided by any third party provider.
Changes to the Terms
We may revise and update these Terms at any time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter. If you continue to use this Site after any revisions take effect, you hereby agree to be bound by the revised Terms. You are expected to check this page each time you access this Site so you are aware of any changes, as they are binding on you. Additionally, you hereby agree that we shall not be liable to you or to any third party for any modification of the Terms.
Changes to the Site and Access
We may update the content on this Site from time to time, but its content is not necessarily complete, accurate or up-to-date. Any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material. We reserve the right to withdraw or amend this Site, and any service or material we provide on the Site, in our sole discretion without notice. This Site and its content are provided “as is” with all faults and defects. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site, or to the entire Site, to users. To access the Site or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Site that all the information you provide on the Site is correct, current, and complete. We have the right to disable any user or restrict access to any use at any time in our sole discretion for any or no reasons, including, if in our opinion, you have violated any of these Terms.
Children Under the Age of 18
The Site is not intended for children under eighteen (18) years of age. No one under age 18 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Site or through any of its features, register on the Site, make any donations through the Site, or provide any information about yourself to us, including your name, address, telephone number, or email address. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. Intellectual Property Rights
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Grant Ready Kentucky, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, for any other use.
You must not modify copies of any materials from this Site, or delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this Site. You must not access or use for any commercial purposes any part of the Site or any services or materials available through the Site. If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Site in breach of the Terms, your right to use the Site will stop immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Site or any content on the Site is transferred to you, and all rights not expressly granted are reserved by us. Any use of the Site not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.
Prohibited Uses
You may use the Site only for lawful purposes and in accordance with these Terms. In order to make online donations, you must be at least 18 years of age, and you must provide all requested information. All payments are subject to payment-processors’ terms and conditions and/or policies. By providing such information, you represent and warrant that all such information is accurate, current, and complete and that your donation complies with all applicable laws and regulations. By using the Site’s payment methods (e.g., VISA, Mastercard, Paypal), you confirm that you possess the legal authority to agree to these Terms, including without limitation, instructing us or our authorized vendors to collect any payments from a credit or debit card, and to use the Site in accordance with these Terms. You expressly authorize us or our authorized vendors to charge the applicable payment mechanism provided by you for any outstanding fees or costs due to us or any donations submitted by you via this Site. Verification of information applicable to a donation may be required prior to acceptance. All donations are subject to acceptance by us and may be rejected by us for any reason.
Geographic Restrictions
The owner of this Site is based in the Commonwealth of Kentucky in the United States. We provide this Site for use only by persons located in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with all applicable laws.

WE MAKE AVAILABLE THE SITE AND SERVICES FOR GENERAL INFORMATION AND CHARITABLE PURPOSES, AND NOT FOR COMMERCIAL OR FOR-PROFIT PURPOSES. Indemnification
You agree to defend, indemnify, and hold harmless Grant Ready Kentucky, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.
Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
JURY AND CLASS ACTION WAIVER. YOU AGREE THAT BY AGREEING TO THE TERMS, YOU AND GRANT READY KENTUCKY ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. YOU AND GRANT READY KENTUCKY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. CLASS ACTIONS AND CLASS ARBITRATIONS ARE STRICTLY PROHIBITED.
LIMITATION ON TIME TO FILE CLAIMS. ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
Governing Law and Jurisdiction
All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the Commonwealth of Kentucky without giving effect to any choice or conflict of law provision or rule (whether of the Commonwealth of Kentucky or any other jurisdiction).
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Kentucky, in each case located in the City of Lexington and County of Fayette. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Waiver and Severability
No waiver by Grant Ready Kentucky of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Grant Ready Kentucky to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
